Trump Allies Ask High Court to Nullify Biden’s Pennsylvania Win

The U.S. Supreme Court in Washington, D.C., U.S., on Monday, Nov. 30, 2020. Congress faces a rapidly approaching deadline to pass a new round of funding for the U.S. government, with dimming odds of hashing out another coronavirus relief package.

In a long-shot request, Republican allies of President Donald Trump say they have asked the U.S. Supreme Court for an emergency order that would nullify Pennsylvania’s certification of Joe Biden’s election victory in the state.

The filing by lawmakers led by U.S. Representative Mike Kelly contends that the Pennsylvania General Assembly exceeded its power by allowing universal mail-in voting for the 2020 election

In rejecting the lawsuit Saturday, the Pennsylvania Supreme Court said Republicans waited too long to sue and were now advocating the “extraordinary proposition that the court disenfranchise all 6.9 million Pennsylvanians who voted in the general election” and throw the decision to the state legislature.

The new request goes first to Justice Samuel Alito, who handles emergency matters from Pennsylvania. Alito has various options, including denying the request on his own, issuing a temporary order of some sort or immediately referring the matter to the full nine-member court.

Biden would win the presidency even if Republicans somehow nullified his Pennsylvania victory. Trump still would be at least two states short of securing a majority in the Electoral College, which will formally select the next president on Dec. 14.
